Terms of Use

These Terms of Use ("Terms") govern your use of the AskCaddie mobile application ("the App") provided by Qiulin Zhou ("we", "us"). By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. What the App is

The App is a golf GPS and rangefinder tool. It uses your device's location to show distances to the front, centre, and back of the green and to hazards, displays course hole layouts and aerial views, presents green slope and contour information, keeps a scorecard, and offers general yardage-based guidance. The App is an aid for recreational use. It is not a surveying or measuring instrument, and it is not a substitute for your own judgement on the course.

2. Eligibility and account

The core features of the App work without an account. Where the App offers an optional account or sign-in, you are responsible for the accuracy of the information you provide and for keeping your credentials secure. The App is not directed to children under 13 (or the minimum age required where you live), and they may not use it.

3. Licence

We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on devices you own or control, for your own non-commercial use, under these Terms. You may not: copy, modify, or create derivative works from the App except where permitted by law; rent, sell, sublicense, or distribute the App; reverse engineer, decompile, or disassemble the App except to the extent that right cannot be excluded by law; remove proprietary notices; or use the App to build a competing product. You may not use the App for any unlawful purpose, interfere with its operation, or attempt to access it other than through the interfaces we provide.

4. Free version, ads, and purchases

The App is free to download. The free version is supported by advertising and lets you use the core distance features, keep a scorecard, and read a limited number of greens. Reading further greens and unlocking the App's premium features require a purchase.

5. Distance, slope, and course data; "as is"

Distances, slope, and elevation readings depend on your device's GPS and sensors, satellite reception, the course data available, and the conditions of play, and are approximate. The App is not a precision measuring instrument, and we do not warrant the accuracy of any distance, slope, elevation, or position it displays. Course data is provided on an "as is" basis and may be incomplete, out of date, or unavailable for a given course, and may differ from the course as it is actually played.

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, that location will be available or accurate in all places, or that results will be correct on every device.

6. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your reliance on any distance, slope, course data, or other output of the App, or from a decision you make during play or competition. Our total liability to you for all claims arising out of or relating to the App or these Terms shall not exceed the amount you paid us, if any, for the App in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence.

7. Intellectual property

The App and its content — software, text, graphics, course data, layouts, and design — are owned by us or our licensors and are protected by law. Apart from the licence in Section 3, these Terms grant you no rights in the App or its content. We reserve all rights not expressly granted.

8. Use during play and competition

You are responsible for using the App in a way that complies with the rules under which you are playing. Under the Rules of Golf, a player may obtain distance information, but the use of a device to gauge or measure slope or elevation change is not permitted in competition unless a Local Rule allows it. Before using slope, elevation, or any related feature in a competition, you must confirm that it is permitted under the applicable rules and any Local Rule in force. We are not responsible for any penalty, disqualification, or other consequence arising from your use of the App during play or competition.

9. Third-party services

The App relies on operating systems, app distribution platforms, payment platforms, mapping and imagery providers, and other third-party services. We are not responsible for the availability or conduct of those services, and your use of them is subject to their own terms. The data those services collect is described in our Privacy Policy.

10. Changes, suspension, and termination

We may update the App and these Terms. Material changes to the Terms will be presented in the App; continued use after an update means you accept the updated Terms. We may suspend or stop the App, in whole or in part, at any time. You may stop using the App at any time by uninstalling it. The sections that by their nature should survive termination (including Sections 5 to 7) survive.

11. Governing law

These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have where you live.
